Both the defending doctor and the patient are allowed to select one doctor to serve on the panel. These two doctors select a third member of the panel and an attorney serves as a non-voting chairman.
The panel will review claims on both sides and decide if the evidence supports the patient's complaint. The decision of the panel does not decide the case and the plaintiff has every right to continue on to court.
